Attention: The procedure outlined below is to be completed after you have placed your order, submitted a deposit to Rising Sun Cycles and we have supplied you with the necessary Frame Number and photos.

For 2009 and going forward all Racing Motorcycles must be pre-approved to the end user by DOT/NHTSA and the EPA for US Customs Entry.

The information below will explain how this will be done and supply sample completed documents as well as the forms you will need to fill out and mail or scan and email to the correct agency. You will first ask for an approval from DOT/NHTSA. This approval will be added to the application that will be sent to EPA for final Racing Exclusion approval and then added to US Customs Clearance paperwork. If you are using Rising Sun Cycles we will need the copies of these papers for import clearance otherwise your import broker will need these forms. This is all a simple process. These agencies work for us, the taxpayers, and are only making sure that any machines imported into the USA are properly approved and documented for entry and used for the purpose you have requested an approval for.

Requirements to lawfully import off-road cycles.
NHTSA regulates the importation of a “motor vehicle,” which is defined in the controlling statute (49 U.S.C. 30102) as “a vehicle driven or drawn by mechanical power and manufactured primarily for use on public streets, roads, and highways.” Vehicles (such as racing bikes, dirt bikes, or ATV’s) that are not “primarily manufactured for on-road use” do not qualify as motor vehicles, and may be lawfully imported without regard to whether they were originally manufactured to comply with all applicable FMVSS. Vehicles that are not primarily manufactured for on-road use may be entered under Box 8 on the HS-7 Declaration form to be given to Customs at the time of entry. To support a Box 8 entry, the importer must furnish Customs with a substantiating statement to establish that the vehicle was not primarily manufactured for on-road use.

This completed form along with your pictures will be sent to the address at the bottom of the form.
The request letter must be submitted in the format shown. The complete package must be submitted at one time (multiple non-complete communications cannot be accepted). The pictures must be in color and they must provide a printed copy of a schedule of events (usually published by the sanctioning body).

REQUIREMENTS

** You must first receive EPA's approval.  Not all vehicles used in races are excluded from emissions compliance.  Determinations are based on the capability of the vehicle, not its intended use.  Importer must submit the following information when applying:

   1. Importer’s / owner’s name, address, and daytime telephone number;
   2. Vehicle information (make,  model, model year and VIN);
   3. A list of racing features (features that make the vehicle a racing vehicle);
   4. A list of street features lacking (features that have been removed or have never been
       installed that would permit safe driving on streets or highways);
   5.  At least 5 clear color photographs showing the front, rear, and each side view
   6  The current value of the vehicle in U.S. dollars;
   7.  Copy of letter from the U.S. Department of Transportation (DOT) staring that they
        have no objection to this vehicle being imported for racing:  Contact: DOT @ 202-366-5300
   8.  The name of the sanctioning body;
   9.  Name of the racing series and copy of racing license for that series, (if required).
  10. A printed schedule of racing events, including data and locations where the vehicle
       will participate; and 
        * The importer must file with Customs, upon entry, an EPA Form 3520-1 declaring
            code  "L" in block 8 and attach the EPA letter of approval; and
        * The importer should keep a copy of the EPA approval letter for future proof of
           EPA exclusion.
